The report was released on the occasion of the official establishment of the Guangdong–Hong Kong–Macao Greater Bay Area Regional Center of the CCPIT Mediation Center at the Foshan Central Legal Services District.This development provides enterprises in the Greater Bay Area with an additional professional and convenient option for resolving commercial disputes locally. According to Ms. Cai Chenfeng, the new center is expected to provide independent, neutral, professional, and efficient mediation services, thereby contributing to the development of a market-oriented, law-based, and internationalized business environment.
The report indicates that commercial mediation in China achieved significant institutional progress during the 2023–2024 period.
A number of documents were issued at both the central and local levels, including the Resolution of the Third Plenary Session of the 20th Central Committee, the State Council’s 2024 Legislative Work Plan, as well as regulations and development plans for the Greater Bay Area, Pudong, Hangzhou, Dongguan, and Inner Mongolia. These policies encourage business entities to choose mediation and arbitration as methods of dispute resolution, while also promoting the development of mediation rules and institutions aligned with both Chinese characteristics and international standards.
In practice, the mediation institutional system has developed rapidly. In 2023 and 2024 alone, at least 306 new commercial mediation organizations were established under the models of private non-enterprise entities and social organizations. At present, 76 mediation centers have been established across key provinces, municipalities, and industries.The number of cases also increased significantly, rising from 3,809 cases in 2020 to 12,509 cases in 2023, representing an average growth rate of approximately 48%. In the first half of 2024 alone, 6,366 cases were accepted, with a total value of RMB 39.78 billion.However, the Report also points out several challenges, including geographical imbalances, inconsistencies in the quality of rules and regulations, uneven professional capacity among mediators, and limited proactive channels for case referrals.
